Privacy Policy

Papa Brand Management Ltd., Company Registration No. 516093192, of 6 HaMif’alim St., Petah Tikva 4951376 (hereinafter: “the Company,” “Papa Johns,” “we,” or “us”), respects your right to privacy. The Company is the controller of the database subject to this Privacy Policy. For inquiries, please contact us using the methods detailed in the “Contact Us” tab on the website. We wish to enable you to make informed decisions regarding the use of your information.

The purpose of this Privacy Policy is to explain how the Company handles information collected through our website and mobile application (hereinafter jointly: “the Site”) or through services provided by the Company, including its loyalty club (hereinafter jointly: “the Services”), and how the Company collects, uses, discloses, and protects information received from users.

The Privacy Policy is written in the masculine gender for convenience only and refers to both women and men. Terms used in this document that are not expressly defined herein shall be interpreted in accordance with the definitions provided in the Terms of Use found on the Site.

**Information We Collect**

“Personal Information” or “Information” is information that can be associated with an individual or entity, such as a name, telephone number, or email address. For some of the services we provide, including joining our loyalty club (hereinafter “Loyalty Club”) and making purchases on the Site, providing personal information is required. As part of the registration for the Loyalty Club, you will be required to provide us with information including your name, email address, mobile number, date of birth, preferred branch, additional dates for receiving benefits (such as the birthday of your spouse or children), information about your purchases, and other information you provide in connection with Loyalty Club activity (“Details collected in connection with the Loyalty Club”). The list of details collected in connection with the Loyalty Club may change from time to time, including in accordance with relevant activity, and is in any case subject to your consent. Additionally, if you contact us, whether through the Site or via other means, we will collect information related to your inquiry. For example, if you inquire about catering services, we request information regarding the date and time of the event, the number of guests, and relevant information regarding special needs for the event or participants.

As part of registration for purchases on the Site, you will be required to provide us with information including your name, address, and mobile number. Furthermore, additional information we may collect from you includes your email address, date of birth, gender, and address. Additionally, if you log in using “Facebook” or other social networks, we will receive the Personal Information provided by Facebook or the relevant social network. Please review the policy of the social network you use to access the Site to understand what information is transferred to us.

If you are a franchisee interested in opening one of our branches, you will need to provide us with the following information: full name, email, phone number, city, branch location, equity information, and employment status.

You are under no legal obligation to provide us with the information, and the provision of information is subject to your desire and consent. However, if you do not agree to provide the information, in whole or in part, some of the services we provide may be unavailable to you, and/or you may be unable to receive the services, and regarding your consent to the collection of details related to the Loyalty Club – you will not be able to register or continue participating in the Loyalty Club.

We may also retain other details about your use of the Services, such as advertisements you viewed on the Site, the pages you browsed, or offers and services that interested you. Certain information may be collected automatically, such as information about your computer, browser, operating system, IP address, and/or mobile device, as well as your location.

If you have downloaded our application from Google Play, we collect your device’s Android App Set ID.

**How We Protect Information**

We take industry-standard measures to protect the information provided to us, both during transmission and after we receive it. However, no method of electronic transmission or storage is completely secure. Therefore, although we strive to use acceptable means to protect your information, we cannot guarantee its absolute security.

We will delete any personal information we have received from a user upon receipt of a written request from that user. We cannot recover deleted information.

**How We Use the Information**

We will not share your information with other parties without your express consent, except as expressly mentioned here, and unless required to do so by any law, regulation, or court order, or to cooperate with an investigation by law enforcement authorities.

We use the information you provide to us to deliver the Site and our Services, such as sending your orders to you, and sending information about promotions, news, or events via email, SMS, or other means.

We may use the information for our internal needs, such as to diagnose problems with our servers or to make our services more useful or tailored to your needs.

We use the Android’s App Set ID for analytics purposes and to prevent fraud. We do not link the Android’s App Set ID to Android advertising identifiers (e.g., AAIDs) or any other personal information for advertising purposes. We process the Android’s App Set ID in accordance with Google Play’s User Data Policy.

The personnel authorized to access Personal Information currently include: Database Manager, Marketing Manager, IT and Computer Systems Manager, and Site Managers. Please note that this list may change from time to time.

**Your information may be transferred to:**

* Companies affiliated with us, or to suppliers and/or subcontractors, such as suppliers that collect, process, and/or store information for us, such as cloud storage providers, including AWS, as well as suppliers through whom payments for purchases on the Site are processed. These suppliers will share with us information such as: the first and last 4 digits of your credit card and a secure token to identify the charge without exposing credit card details, a device- or company-specific account number, shipping address, billing address, and/or your email address. We will require our affiliated companies, suppliers, and/or subcontractors to act according to our privacy protection procedures.
* An independent supplier that sends direct marketing messages on our behalf to Papa Club members, which gains access to information related to Loyalty Club activity or information required for the purpose of contacting you as part of direct marketing. This information includes the list of details collected in connection with the Loyalty Club.
* Business partners with whom we may jointly offer products or services, or whose products or services are offered on our site.
* If you choose to use these products or services, we may share information about you, including your Personal Information, with those partners. Please note that we do not control the privacy practices of these business partners. If you no longer wish to allow a third party to use your information, please contact that third party.
* Referrals from and to other websites. If you were referred to this site from another site (e.g., via a link), we may share certain information about you with the referring site. We encourage you to review the privacy policy of any site that referred you to our site. Additionally, when you move to a partner’s site via a link from our site, we provide that partner a unique identifier so they know you were referred from our site. This unique identifier will not contain your Personal Information.

Additionally, through the analysis of all information we collect or receive, including information about users, we may create statistical information about a wide range of users (hereinafter: “Statistical Information”). Statistical Information helps us understand trends and user needs so that we can consider new services and products and adapt existing services and products to users’ needs. Statistical Information is anonymous, and we do not link it to Personal Information. We may disclose Statistical Information to our partners, without limitation, under commercial terms determined at our sole discretion.

We may analyze statistical data using software that provides information and statistical analysis services, including, but not limited to, Google Analytics (“Analytical Tools”). The collected information is intended for analysis, research, and control purposes. We may transfer statistical data to our clients and business partners (as detailed below). We also use information obtained through Analytical Tools to improve the system. The information that Google Analytics collects following your use of the system is subject to the Terms of Use and Privacy Policy of Google Analytics as set forth below: https://marketingplatform.google.com/about/analytics/terms/us/

The cookies we use may change from time to time. In any case, the types of cookies we generally use fall into the following categories:

**Use of Services by Children**

The Company does not knowingly collect identifying information from children under the age of 13. In the event you become aware that a child under the age of 13 has registered without the consent of their parent or guardian, please notify us immediately.

**Other Uses and Data Transfer**

We will cooperate with law enforcement authorities or any judicial order requiring or directing us to disclose the identity, conduct, or digital content of any user suspected of engaging in actions that appear to be unlawful or actions that break the law. We may transfer your information to our affiliated companies, including those located outside of Israel. We may use the services of subcontractors located in countries other than your country of residence, including countries outside of Israel, and send them the information we receive. All subcontractors will be subject to non-disclosure and non-use obligations. Nevertheless, some countries may have levels of protection for personal information or other data that do not equate to the level of protection in your country. We may transfer our databases containing your information if we sell our business or part of it, including during negotiations regarding such a transaction, including in connection with liquidation, and including a transfer outside of Israel.

**Reviewing, Correcting, or Updating Your Information**

We allow you to review the information you provided during registration and to change data, inaccuracies, or errors in the information. Pursuant to Sections 13 and 14 of the Protection of Privacy Law, 5741-1981, you are entitled to view it yourself, or by an attorney authorized by you in writing, or by a guardian, as the case may be, to view information about yourself. If you request to view the information, we will allow this, according to the conditions stipulated in the law and subject to the provisions of any law. Sometimes the information is held by a third party (“the Holder”), in which case we will refer you to the Holder and instruct the Holder to allow the review. If, after such review, you find that the information is incorrect, incomplete, unclear, or out of date, you will be entitled to contact us (or if you are a foreign resident, the Holder) and request to correct the information about you or delete it. We will decide on the request, notify you of our decision, and act according to the law. To request to view the information or to correct and update your Personal Information, contact us through the Customer Service tab. In some cases, you may also have the right to request deletion of the information.

We will retain your information as long as your account is active or as needed to provide you with services. If you wish to close your account or request that we stop using your information to provide you with services, contact us at the email address provided above. We will retain your information and use it as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

**Communication and Notifications**

Provided you have consented, we may send you newsletters and promotional messages via email, as well as SMS or other commercial messages regarding us or our products and services. You agree to receive such commercial messages when you indicate that you wish to join the Papa Club, whether through the registration form on the homepage, by confirming the relevant field in the order itself, or by registering for direct mailing and/or registering for the club in any other way. This includes us potentially conducting campaigns on social networks where participation involves registration for the Papa Club.

You may remove your personal details from our mailing list and stop receiving future messages from us by clicking the removal link at the bottom of the email or by sending the word “Remove” to phone number 0529990512 – all removal methods appear in the body of the email or message received from us.

Please be aware that we reserve the right to send you messages related to the Services, including service messages and administrative messages, regarding your account, without offering you the option to opt out, unless you close your account.

**Changes to the Privacy Policy**

Our Privacy Policy may change from time to time. Should changes be made to the Privacy Policy that involve a reduction of your rights or a different use of the Personal Information you provided, a notice will be published on the Site.
